Copyright & Takedown
Last updated
Novapex Studio respects the intellectual property of others and expects the people who use our Services to do the same. This page explains how to report content on novapexstudio.com or in one of our apps, games or websites that you believe infringes your copyright, and how we handle such reports. It follows the notice-and-takedown model of the United States Digital Millennium Copyright Act (DMCA) and the Indian Copyright Act, 1957 and Information Technology rules, and we apply it to reports from anywhere in the world.
1. Our own content
Unless stated otherwise, the text, images, logos, designs, code, audio and other material on the Site and in our products are owned by Novapex Studio or our licensors and protected by copyright and other laws. You may share links to our pages and quote short excerpts with attribution. For any other use, including redistribution of our apps, assets or articles, ask first at [email protected]. Third-party fonts, libraries, badges and other licensed material remain the property of their owners and are used under their licences.
2. How to report an infringement
If you are a copyright owner, or authorised to act for one, and believe that material we host or publish infringes your copyright, send a notice by email to [email protected] with the subject line "Copyright notice". To be valid, your notice must include:
- Identification of the copyrighted work you claim has been infringed (or a representative list if several works are covered), with a link or copy where possible.
- Identification of the material you claim is infringing, with enough detail for us to find it: the exact URL on the Site, or the app or game name, the screen and the item (for example a wallpaper title or an in-game asset).
- Your contact details: full name, postal address, email address and, if you wish, a telephone number.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.
- Your physical or electronic signature (typing your full name is acceptable).
Please send the notice in English or with an English translation. Notices that are incomplete may be delayed while we ask for the missing information. Knowingly making a false claim of infringement may expose you to liability for damages and costs.
3. What we do with a notice
- We acknowledge valid notices within 2 to 3 business days and aim to act on them within 10 business days, or sooner where the law requires it.
- If the notice is valid, we remove or disable access to the material on the Site or in the product, or in the next update where the material is embedded in an app or game, and we may notify the person who posted it, giving them a copy of your notice (without your phone number).
- We keep a record of notices and our response as described in our Privacy Policy.
- We may terminate access for users who repeatedly infringe other people's rights.
4. Counter-notice
If material you posted was removed because of a notice and you believe this was a mistake or that you have the right to use it, you may send a counter-notice to [email protected] containing: identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address and email; a statement that you consent to the jurisdiction of the courts for your address (or, if outside the United States, any judicial district in which we may be found) and that you will accept service of process from the person who sent the original notice; and your signature. We will forward the counter-notice to the original complainant and may restore the material in 10 to 14 business days unless they tell us they have filed a court action.
5. Other rights
To report a trademark issue, a privacy or image-rights concern, defamation, or content that is unlawful for another reason, email the same address with a clear description of the content and the right you believe is affected. Reports of illegal content are handled under the applicable law, including the Indian Information Technology (Intermediary Guidelines) Rules where they apply. Content that you believe violates an app store's policies can also be reported to that store.
