ThemeVerse Terms of Use

These Terms of Use ("Terms") govern your use of ThemeVerse ("the App") published by Novapex Studio ("we", "us"), a digital studio operated by an independent developer based in India. They supplement our site-wide Terms of Use, which apply to anything not covered here. By installing or using the App you agree to these Terms and to the ThemeVerse Privacy Policy. If you do not agree, please do not use the App.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the rules of the app store you obtained it from (for example the Google Play Terms of Service or Apple's Media Services Terms). You must be at least 13 years old, or have a parent or guardian's permission, to use the App.

2. Acceptable use

You agree not to:

• copy, modify, reverse engineer, decompile or create derivative works of the App, or extract its assets, except where the law expressly permits it;
• remove or alter any copyright, trademark or other proprietary notices;
• use the App in a way that is unlawful, harmful or interferes with others' use of the App or of the third-party services it relies on;
• use automated tools to interact with the App or its ads, or attempt to generate fraudulent ad impressions, clicks or purchases.

3. Your content

Anything you create or enter in the App remains yours. Content synced to your account is stored only to provide the account features and is deleted when you delete your account. You are responsible for backing it up; we cannot recover content that is deleted from your device.

4. Purchases

The App may offer in-app purchases, subscriptions or virtual items. They are sold and processed by the app store under its terms and refund rules; see our Purchases & Refunds page. Virtual items have no monetary value, cannot be transferred or exchanged for money, and may change if the App is updated or discontinued.

5. Advertising

The App is supported by advertising and optional purchases served through Google AdMob. Advertisements are provided by third parties; we do not endorse the products advertised and are not responsible for their content. How ads use data is described in the ThemeVerse Privacy Policy.

6. Intellectual property

The App, including its code, design, graphics, audio, text and trademarks, is owned by Novapex Studio or its licensors and is protected by copyright and other laws. Except for the licence above, no rights are granted to you. Third-party names and logos belong to their owners.

7. Updates and availability

We may update, change or discontinue the App or any feature at any time, with or without notice. Updates may be installed automatically depending on your device settings. We do not guarantee that the App will be available at all times, in every country or on every device.

8. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. The App is a personal tool and does not provide medical, psychological, legal, financial or religious advice. See our Disclaimer.

9. Limitation of liability

To the fullest extent permitted by law, Novapex Studio shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising out of or related to your use of or inability to use the App. Our total liability for any claim relating to the App shall not exceed the amount you paid for it (if any) in the twelve months before the claim. Nothing here limits liability that cannot be limited by law or removes statutory consumer rights in your country.

10. Termination

These Terms remain in effect until terminated. You may terminate them at any time by uninstalling the App. We may terminate or suspend your licence or account if you breach these Terms.

11. Governing law

These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.

12. Changes to these Terms

We may revise these Terms from time to time. The date at the top shows the latest revision. Continued use of the App after a change means you accept the revised Terms.
